It is in the public domain in the United States because it was published or registered with the U.S. Copyright Office before Jan 1, 1926

Otto Sommer was a German artist living in Munich before immigrating to the United States – destination, probably New York City, although the year is unknown. What is known that Sommer exhibited at the National Academy of Design from 1862 to 1866.

The December 28, 1864 Philadelphia Press, in their Arts and Literature in New York, section stated that "a large canvas by Otto Sommer, representing a spirited deer scene, will be worthy of your attention, should it reach Philadelphia." Sommer exhibited with well-known artists Balling A. Chappel, Leutze, Nehleg, Culverhouse, Berger W. Hart, S.S. Gerry, Johann Hermann Carmeincke, Seavey and Stroeghel at Bunyon Hall, Union Square in September, 1867.
